Starborn is operated by AIYER, LLC, a Delaware limited liability company (“AIYER,” “we,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Starborn, including the website located at starborn.app and any related services, applications, or features (collectively, the “Service”). By using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Service.
The Service is intended only for individuals who are at least eighteen (18) years old or the age of majority in their jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this requirement.
We do not knowingly collect or process personal data from minors. If we learn that we have inadvertently collected data from a person under the applicable minimum age without verified parental consent, we will delete it.
Starborn is an AI-powered creation platform that enables users to generate digital content and software experiences, including websites, applications, games, prototypes, visual assets, and other creative or interactive outputs, through natural language prompts and structured inputs.
The Service may include both free-to-use features and paid or credit-based functionality.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur via your account.
You agree to promptly notify us of any unauthorized access or suspected security breach.
AIYER is not responsible for losses resulting from compromised credentials or unauthorized account usage.
“Customer Data” means any prompts, text, code, design assets, instructions, uploaded materials, brand materials, or other content you provide or generate within your account.
You retain ownership of your Customer Data.
By submitting or creating Customer Data, you grant AIYER a limited, non-exclusive license to store, process, and display such data solely for the purpose of operating, maintaining, and improving the Service.
We do not claim ownership of your Customer Data, and we do not publicly disclose or redistribute it.
AIYER does not use identifiable Customer Data to train models. However, we may use anonymized and aggregated usage patterns to improve system performance, reliability, and safety.
You are solely responsible for ensuring that your Customer Data does not:
All technology, architecture, software, interfaces, algorithms, training data, design systems, documentation, and other materials that power or comprise the Service (“AIYER Materials”) are owned by AIYER or its licensors.
Except for the limited rights granted under these Terms, no ownership of AIYER Materials is transferred to you.
You may not reproduce, modify, reverse-engineer, resell, or attempt to extract source data, model weights, or proprietary systems from the Service.
“Output” refers to the results and creative or functional materials produced by the Service based on your prompts, including but not limited to code, software, applications, games, text, layouts, design assets, prototypes, or other generated work.
AIYER grants you a license to access, use, reproduce, and commercially exploit the Output to the extent permitted by applicable law.
This is a license, not a transfer of ownership, because AI-generated content may not be eligible for copyright protection in all jurisdictions.
AIYER does not guarantee that Outputs are unique, error-free, or non-infringing.
If Outputs include software code, applications, games, or other executable or interactive experiences, you are solely responsible for:
AIYER provides generated software “as-is” and does not guarantee that Outputs are secure, bug-free, compliant, or fit for a particular purpose.
The Service may offer a free tier, paid subscription plans, and usage-based Credits that enable additional generations or premium functionality.
Credits are non-transferable units consumed when using certain AI-powered operations or premium functionality. Free credits expire every 30 days. Paid credits are provided on a recurring, subscription-based cycle and expire at the end of each billing period. Unused credits do not roll over or accumulate between billing cycles. Credits have no cash value and cannot be exchanged for currency or refunds.
Subscriptions renew automatically unless canceled before the renewal date.
All fees are non-refundable except where required by law.
You are responsible for any applicable taxes associated with your purchase or use of the Service.
You agree not to use the Service to:
Violation may result in account suspension or termination.
You may choose to deploy or publish Outputs (including code or applications) to third-party platforms, such as cloud hosts, app stores, gaming platforms, or development frameworks.
You are solely responsible for:
AIYER is not liable for third-party decisions, rejections, moderation actions, or enforcement outcomes relating to your deployments.
Customer Data and associated project files are stored until you choose to delete them or request account removal.
Upon deletion, AIYER will remove Customer Data from active systems. Certain backup or archival copies may persist temporarily for disaster recovery or compliance purposes, after which they are purged.
AIYER may collect limited analytics and diagnostic information to operate and improve the Service, including:
Infrastructure is globally distributed, which means Customer Data may be processed outside the user’s home jurisdiction, subject to industry-standard security measures.
AIYER may use anonymized and aggregated usage data to improve the Service’s performance and reliability, but will not use identifiable Customer Data for public marketing, disclosure, or model training without explicit consent.
You may discontinue use of the Service at any time.
AIYER may suspend or terminate your access if:
Upon termination, your license to use the Service and any Outputs ceases immediately, except for Outputs you have already exported or deployed outside the platform.
We may retain certain records as required by law or for legitimate business purposes, consistent with our Privacy Policy.
The Service and all Outputs are provided “as is” and “as available” without warranties of any kind, express or implied.
AI-generated content may be incomplete, inaccurate, or non-unique.
AIYER does not warrant that:
Use of the Service is at your own risk.
To the fullest extent permitted by law:
AIYER’s total cumulative liability for any claim arising out of or relating to the Service shall not exceed the total amount you paid to AIYER in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so certain portions of this section may not apply to you.
These Terms are governed exclusively by the laws of the State of Delaware, without regard to its conflict of law rules.
Any dispute, claim, or proceeding arising out of or relating to the Service shall be brought in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. Material changes will be posted to starborn.app or communicated within the Service.
Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of the revised Terms.
